Terms of Service

1. Introduction

Welcome to Archgyan ("Academy", "we", "us", or "our"), an online education platform specializing in architecture, BIM, and AEC (Architecture, Engineering & Construction) software training. These Terms of Service ("Terms") govern your access to and use of our website at archgyan.com, including all courses, content, features, and services offered through the platform.

By creating an account, enrolling in a course, or otherwise accessing the Academy, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Academy.

2. Definitions

  • "Content" refers to all video lessons, text materials, quizzes, downloadable resources, captions, and any other educational material available on the Academy.
  • "Course" refers to a structured collection of lessons and resources offered on the Academy, whether free or paid.
  • "User", "you", or "your" refers to any individual who accesses or uses the Academy.
  • "Subscription" refers to a recurring payment plan that grants access to subscription-included courses for the duration of the active billing period.

3. Eligibility

You must be at least 18 years of age to create an account and use the Academy. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

If you are accessing the Academy on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

To access certain features, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information, are used fraudulently, or violate these Terms.

5. Acceptable Use

When using the Academy, you agree not to:

  • Share, distribute, or reproduce any course content without written permission.
  • Share your account credentials or allow others to access your account.
  • Use automated tools, bots, or scrapers to access or download content.
  • Record, capture, or redistribute video lessons or downloadable resources.
  • Attempt to circumvent access controls, security measures, or payment requirements.
  • Use the platform for any unlawful purpose or in violation of any applicable laws.
  • Upload or transmit harmful content, including viruses or malicious code.
  • Interfere with the platform's operation or other users' experience.

6. Courses & Content

The Academy offers online courses related to architecture, BIM software (such as Autodesk Revit, SketchUp, V-Ray, and others), and AEC industry practices. All educational content is provided for informational and learning purposes only.

Professional disclaimer: Course content does not constitute professional architectural, engineering, or construction advice. Any techniques, methods, or workflows demonstrated should be verified by qualified licensed professionals before being applied to real-world projects. We are not responsible for any outcomes resulting from applying course content in professional practice.

We reserve the right to update, modify, or remove courses and content at any time to improve quality or accuracy.

7. Payments & Pricing

The Academy is offered as a Pro subscription. All prices are displayed in USD and are subject to change with reasonable notice.

Subscriptions

Subscriptions are billed on a recurring basis (monthly or yearly, as selected). By subscribing, you authorize us to charge your payment method automatically at each billing cycle. You may cancel your subscription at any time through your Account Settings, and cancellation will take effect at the end of the current billing period. You retain full access until then and will not be charged again.

Subscription Credits

Each active Pro subscription includes a monthly allowance of AI credits that can be spent on AI workflows (rendering prompts, portfolio reviews, presentations, diagrams, thesis writing, studio briefs) and on Marketplace products. The current allowance is published on the Pricing page and may change with reasonable notice.

Monthly plans receive that month's credits at the start of each billing period. Unused credits expire at the end of the period.

Yearly plans receive all twelve months of credits upfront at activation and at each renewal. If you cancel a yearly subscription before the end of your prepaid year, we will forfeit (remove from your balance) the pro-rated unused share of those upfront credits, calculated on the months you will not use. The credits you have already earned and any credits you have already spent are unaffected, and your balance is never reduced below zero. Cancellations on monthly plans do not trigger any credit forfeiture.

Credits purchased separately through a Marketplace credit pack are not subscription credits and are never forfeited on cancellation.

Payment Processing

Payments are processed securely through Stripe. We do not store your full payment card details on our servers. By making a payment, you agree to Stripe's terms of service. You are responsible for any applicable taxes associated with your purchase.

8. Refund Policy

We want you to be satisfied with your learning experience. The policy depends on your plan.

8.1 Pro Monthly subscription

Monthly subscriptions can be cancelled at any time from your Account page. You retain access to all subscription content until the end of your current billing period. Because each monthly payment only covers the current period (which you keep using), refunds are not provided for monthly subscriptions.

8.2 Pro Yearly subscription (pro-rated refund)

You may cancel at any time, and access continues until the end of your prepaid year. If you cancel before the end of that year, you may request a pro-rated refund for the months you will not use.

Base calculation: Refund = Annual price × (whole months remaining ÷ 12), where "whole months remaining" is counted from the date your refund request reaches us to your original period-end date.

We may adjust this in two specific cases:

  • Goodwill window (7 days): Within 7 days of your original yearly payment, we will refund the full amount (no pro-ration applied) provided you have not completed more than 25% of any course.
  • Usage adjustment: If you have consumed a substantial portion of one or more courses (typically more than 25% of any single course, or 10% across multiple courses), we may apply a reasonable usage adjustment reflecting the value you have already received.

How to request:

  1. Cancel your subscription from Account → Manage billing & cancel (this routes through Stripe and offers any active retention discount before confirming).
  2. Return to your Account page and use the Request a pro-rated refund for unused months form.
  3. The founder personally reviews every request and replies within 2 business days. Approved refunds are issued to your original payment method within 5 to 10 business days.

8.3 Other refunds

For anything not covered above, please contact us at support@archgyan.com with your order details.

8.4 Anti-abuse

If we believe you are abusing our refund policy, for example if you have consumed a significant portion of a product you want to refund or if you have previously refunded similar products, we reserve the right at our discretion to deny the refund, disable your account, and/or restrict future use of our services. If we disable your account due to a violation of these Terms or other policies, you will not be eligible to receive a refund.

9. Community

Archgyan provides access to a student community on Discord as a supplementary resource. By joining the Discord server or any other community channel associated with the Academy, you agree to:

  • Treat other members with respect and professionalism.
  • Not share, redistribute, or post course content, video links, or downloadable resources in community channels.
  • Not post spam, promotional content, or off-topic material without prior consent.
  • Not engage in harassment, hate speech, or discriminatory behavior of any kind.

Participation in community channels is subject to the platform rules of the respective service (Discord). We reserve the right to remove access to community resources for any user who violates these guidelines or these Terms.

10. Intellectual Property

All content on the Academy, including but not limited to videos, text, graphics, logos, course materials, quizzes, downloadable resources, and software, is the property of Archgyan or its content creators and is protected by copyright and intellectual property laws.

Your enrollment in a course grants you a limited, non-exclusive, non-transferable, revocable license to access and view the course content for personal, non-commercial educational purposes only. This license does not permit:

  • Reproducing or distributing course materials.
  • Creating derivative works based on the content.
  • Using course content for commercial training or resale purposes.
  • Removing or altering any copyright notices or proprietary markings.

Third-party software names (Autodesk Revit, SketchUp, V-Ray, etc.) are trademarks of their respective owners. Their use on this platform is for educational reference only and does not imply endorsement or affiliation.

11. Account Suspension & Termination

We may suspend or terminate your account and access to the Academy if:

  • You violate these Terms or our Acceptable Use policy.
  • We detect fraudulent, abusive, or unauthorized activity on your account.
  • You share course content in violation of our intellectual property rights.
  • You fail to pay for services or your payment method is declined.

To cancel your subscription, visit your Account Settings. To delete your account and personal data, submit a deletion request through our Privacy Settings page or contact us at support@archgyan.com. Upon account termination, your access to paid content will be revoked. We may retain certain data as described in our Privacy Policy.

12. Disclaimer of Warranties

The Academy and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

  • The platform will be uninterrupted, error-free, or secure at all times.
  • Course content will be completely accurate, current, or free from errors.
  • Completion of a course will result in specific career outcomes, certifications, or professional qualifications.
  • The platform will be compatible with all devices, browsers, or internet connections.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Archgyan and its owners, officers, employees, and content creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Academy, including but not limited to:

  • Loss of data, revenue, profits, or business opportunities.
  • Damages arising from reliance on course content in professional practice.
  • Service interruptions, server downtime, or technical failures.
  • Actions of third-party service providers (payment processors, hosting, CDN).

Our total liability for any claim arising under these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Archgyan, its owners, employees, and content creators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Academy, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good faith negotiation first. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts in India.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where practical, providing notice through the Academy or via email. Your continued use of the Academy after changes are posted constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
